1. Acceptance and scope
By accessing or using Visible Folder, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service. These terms apply to everyone the service touches: photographers with accounts, the recipients they deliver to, and anyone who contributes photographs through a receive portal.
Visible Folder is a photo delivery service. You upload finished work, arrange it into albums, and deliver it to the people who are waiting for it. Some deliveries are open to anyone with the link, and some are protected by passwords or email confirmation. You are responsible for choosing the right protection for each delivery.
2. Eligibility and account responsibility
You must be legally able to enter into this agreement and comply with applicable law where you live and where your photographs are uploaded, stored, or downloaded. If you create an account, you are responsible for the accuracy of your account information, the security of your credentials, and all activity that occurs under your account.
3. Prohibited content and conduct
Visible Folder may not be used to upload, store, or share illegal material. This includes, without limitation, child sexual abuse material, sexually exploitative material involving minors, non-consensual intimate imagery, material that facilitates trafficking or abuse, and any content whose possession or distribution is unlawful.
Because the service carries photographs, you also may not deliver images you do not have the right to share — including photographs that infringe someone's copyright or that violate the privacy or publicity rights of the people in them. You also may not abuse rate limits, scrape the service, interfere with deliveries, or use automation in a way that degrades availability or safety for others.
4. Moderation, removals, and reporting
We may investigate photographs, metadata, access logs, and related account activity when needed to enforce these terms, protect the service, respond to abuse reports, or comply with legal obligations. We may remove photographs, disable deliveries, suspend accounts, preserve evidence, or permanently ban users at our sole discretion.
We are not required to pre-screen every photograph or continuously monitor every delivery. The absence of immediate action does not mean any content is permitted.
5. Law enforcement, safety, and rights-holder requests
We take reports involving illegal material seriously. We may preserve records and disclose account, photograph, or access information when we believe disclosure is required by law, supported by valid legal process, or necessary to prevent death, serious harm, fraud, or abuse of the service.
Rights holders, safety organizations, and law enforcement may contact us to report content or request preservation. Contact: [email protected]. Fraudulent, abusive, or unsupported requests may be rejected.
6. Your photographs and your rights
You retain whatever rights you already have in the photographs you upload. You grant us the limited rights needed to host, store, and transmit those photographs, to prepare thumbnails and gallery previews from them, and to display them to the recipients you choose, for the purpose of operating, securing, and improving the service. You represent that you hold the necessary rights in your photographs — including any permissions from the people photographed — and that delivering them through the service does not violate law or third-party rights.
7. Availability and third parties
The service may change at any time. Features may be added, removed, rate-limited, or interrupted without notice. Donut Rodeo may rely on third-party providers for hosting, storage, delivery, email, payment processing, or related infrastructure. Your use of those third-party components may also be subject to their terms.
8. Termination
We may suspend or terminate access immediately if we believe you violated these terms, created legal risk, endangered users, or used the service in a way that is abusive or unlawful. We may retain information as needed for backups, security, dispute resolution, and legal compliance after termination.
9. Disclaimers and limitation of liability
The service is provided on an as-is and as-available basis without warranties of any kind. To the fullest extent permitted by law, Visible Folder disclaims implied warranties and will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, or business opportunity arising from your use of the service.
10. Paid plans and lapsed subscriptions
If you hold a paid plan, your plan includes a specific storage limit. Photographs in excess of the free plan limit (as defined on our pricing page) may be removed if your paid plan lapses for any reason, including but not limited to payment failure, cancellation, or expiration. You are responsible for maintaining valid payment information and for renewing your plan, and we will attempt to notify you prior to the end of your plan's term. We are not obligated to retain excess photographs after a lapse, and we may remove them without prior notice.
11. Free plan inactivity deletion
Free plan accounts are subject to deletion after as little as six months of inactivity. Inactivity means no account login, no photograph upload, and no delivery or receive portal access associated with the account. Activity does not include unauthenticated visits to public deliveries. We may notify you before deletion using the contact information associated with your account, but we are not required to do so. Once deleted, your photographs cannot be recovered.
12. Governing law and disputes
These terms are governed by the laws of the United States and the State of Wisconsin, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service will be resolved in the state or federal courts located closest to Donut Rodeo's principal place of business in Wisconsin.
13. Changes to these terms
We may update these terms from time to time. Continued use of Visible Folder after an update becomes effective means you accept the revised terms.
